The following are terms and conditions of a legal agreement between you and An Archive and its affiliates (collectively, “AN ARCHIVE”, “we”, “us” or “our”). These terms and conditions govern your use of www.an-archive.com (the “AN ARCHIVE Website” or “Website”).

Through procuring our products would mean that you have acknowledged, read, understood and agree to be bound by these “Terms and Conditions” and to comply with all applicable laws and regulations. If you do not agree with these Terms and Conditions, you should not use the Website and/or purchase AN ARCHIVE products. AN ARCHIVE reserves the right to update and change the Terms and Conditions, whether informed or uninformed, by posting updates and changes to AN ARCHIVE website.


CHANGE OF THE WEBSITE, THE PRODUCTS & TERMS AND CONDITIONS
AN ARCHIVE reserves the right to update, alter, modify or otherwise make changes to the Website, the Products, and these Terms and Conditions at any time. Such amended Terms and Conditions shall be effective upon posting on this Website and will have no effect on sales that were completed before such posting. We will make reasonable efforts to post notices regarding any changes to these Terms and Conditions.


ORDER
(i) Placing an order
By placing an order with AN ARCHIVE, you are
(i) offering to purchase a product,
(ii) representing that you are of legal age to form a binding contract, and
(iii) representing that all information you provide to us in connection with such order is true and accurate and you are an authorized user of the payment method provided.

The receipt by you of an order confirmation does not constitute our acceptance of an order. AN ARCHIVE retains the right to refuse any request made by you.

Prior to AN ARCHIVE’s acceptance of an order, verification of information may be required. We reserve the right at any time after receipt of your order to accept or decline your order, or any portion thereof, even after your receipt of an order confirmation from us, for any reason whatsoever. AN ARCHIVE reserves the right, without prior notice, to limit the number of items ordered and to refuse service to any customer.

(ii) Unacceptable orders, cancellation of orders by us
If a product is available through our Website, the basic assumption is that it can be produced. However, there are technical or other reasons why AN ARCHIVE may not accept or cancel your order during the entire ordering process, even after our acceptance of your order. Such reasons can be, for example, but not limited to the destination of the delivery you indicated in your order, etc. In case we cancel your partial or entire order, we will contact you via email and at AN ARCHIVE's discretion, we will issue you a full refund for the cancelled item(s).

(iii) Product Price
All prices displayed on AN ARCHIVE’s Website are quoted in Singapore Dollars (SGD). The prices displayed are valid only for the moment that they are displayed. AN ARCHIVE reserves the right to make changes to all prices without prior notice and without incurring any obligations to you. Such changes, however, will have no effect on orders completed before the posting of a new price. We do our best to prevent errors in the pricing. However, should an error occur, we are not bound by our offer and may cancel the order. Any monies paid related to that order would be refunded to you.

The actual price charged to overseas customers will be subject to the exchange rate applied by the customer's credit or debit Card Company. Customers outside Singapore will also be liable for any customs/import duty, quotas, permits, product restrictions, and other local requirements. These charges will not be reimbursed by AN ARCHIVE. Customs policies vary widely from country to country; therefore, you are advised to check the latest applicable local requirements in your country before placing an order.

(iv) Product
When editing images for display on our Website, we always strive to produce the most realistic colors of the goods. However, people may perceive different colors as different devices render colors differently. Such situations are not within our control, and we cannot be held responsible for purchases made with the wrong perception of colors.

(v) Payment and Order Confirmation
The amount indicated on the ordering page is exclusive of delivery costs. All payments for your order will be via our payment provider (PayPal or Stripe).

For PayPal, you will be directed to the PayPal website. You can initiate your payment for your order using either your PayPal account or credit card on the PayPal website.

AN ARCHIVE shall not be responsible in any way for the payment process done via the PayPal website. Please familiarize yourself with the terms of use of those services of PayPal.

For Stripe, you can initiate your payment for your order using either your credit card on the within AN ARCHIVE website at the final step during checkout.

We will not proceed into making your order until we receive confirmation via PayPal or Stripe that the transfer of the amount indicated in the order confirmation form has been completed.

(vi) Acceptance
After accepting your order, we will send you an order confirmation to the e-mail address associated with your order. The order confirmation will be effective as of the date on which the order confirmation is sent to you. If we cannot accept your order, we will contact you by email. You should verify the details in the confirmation email. If there are errors, you should contact us as soon as possible via email.

(vii) Order status and cancellation of order
All orders placed through our Shopify store can be cancelled prior to shipping. Once an order has been shipped, it cannot be cancelled.

Please note that sales products are non-cancellable and non-refundable. Once you place an order for a sales product, it cannot be cancelled or refunded.

As a multi-label store, we source our products directly from the original brands. While we strive to ship out orders as quickly as possible, there may be instances where shipping delays occur due to factors beyond our control, such as delays from the original brands. In such cases, we will keep you informed of any delays and work diligently to expedite the shipping process.

If you wish to cancel an order before it is shipped, please contact our customer support team immediately. We will make every effort to accommodate your request, provided the order has not been dispatched for shipping.

(viii) Shipping
Your order will be delivered to your shipping address. We will use our commercially reasonable efforts to deliver the product to the shipping address within the delivery time indicated in our delivery email. More importantly, we understand you want to receive your product(s) quickly.

Unless stated otherwise or for special promotion/projects, any delivery dates given by us are only best estimates.

AN ARCHIVE carries no control over the respective local and international couriers, and we are not liable for any damage and/or cost caused by the delivery process or delay in delivery once the parcel is with the courier.

In the event that the parcel is returned to us due to an incorrect or invalid shipping address provided by the customer, a notification email will be sent to you from info@an-archive.com. The full redelivery cost will have to be accounted for by the customer. Kindly note that any taxes or customs fees regarding your parcel as deemed by your country's legal regulations are to be held responsible by the customer.

Parcels that were unclaimed three months from the order date will be forfeited.


GOODS RETURN AND EXCHANGE POLICY
If you wish to return any goods, you expressly understand and agree to conform to the Goods Return and Exchange Policy and its terms and conditions stated below.

(i) Goods damaged on arrival
If you discover that your goods and/or packaging are visibly damaged on arrival, you should either write on the delivery note that the packaging is damaged or refuse to accept the delivery. Please also contact us within seven (7) days with details of the damage (pictures and description, etc.). This will help us considerably in raising the matter with our appointed courier. Once we receive the damaged goods in our warehouse, we will then replace them for you.

(ii) Goods not as ordered
If you receive a different good from what you have ordered, we strongly recommend that you notify us as soon as possible through our contact page. Please also provide us with your Invoice Number and a clear photo of the mailing envelope (with the mailing label and postage stamps in view) together with the incorrect good received.

(iii) Exchange of goods
Requests for a one-time exchange are allowed only when you have received (i) an incorrect good or (ii) a defective good. Requests for exchanges other than the above reasons will not be entertained.

Regardless of the reason for the request for exchanges, exchanges are allowed only if the good in concern is (i) unwashed and in a (ii) brand new and saleable condition. Requests for exchanges will be rejected if any of the above criteria is not met.

If all of the above criteria have been met, please contact us within seven (7) working days from when the good was dispatched to request an exchange. Requests for exchanges will not be entertained after seven (7) working days from when the good was dispatched. All exchange cases opened (signified by the first reply from AN ARCHIVE) will have 30 days to be completed; AN ARCHIVE will not be obliged to follow up on the case on the 31st day.

All exchanges are assessed on a case-by-case basis, and we reserve the right to exercise discretion in permitting or rejecting all requests for exchanges.

All goods can only be exchanged for the same design. They cannot be exchanged for other products. However, in the event whereby the originally purchased good is out of stock in all colors, you will be offered an exchange for another good of your choice with the same or lesser price than the originally purchased good. You may choose to exchange it for a good of a higher price than the originally purchased good if you are willing to make a top-up of the difference in price.


(iv) Agreement upon returning
If you receive any goods and wish to return the goods to AN ARCHIVE, you expressly understand and agree to conform to the following: a. AN ARCHIVE will accept goods sold only on AN ARCHIVE Website. b. Inspection of the products must be carried out on the date of acceptance of the product (i.e., within the day when you receive the goods itself). c. All returns must be packaged in a manner to prevent any additional damage to the product.


INDEMNIFICATION
You agree to indemnify, defend, and hold AN ARCHIVE and its affiliates, distributors, dealers, agents, and its and their employees harmless from and against all liabilities, claims, actions, demands, damages, costs, and expenses (including reasonable attorney's fees) arising from or relating to any claims that result from your breach of these Terms and Conditions.


MISCELLANEOUS
These Terms and Conditions, together with any other policies, guidelines, or FAQs posted by AN ARCHIVE, represent the complete and exclusive agreement relating to the subject matter hereof, which supersedes any proposal or prior agreement, oral or written, and any other communications between you and AN ARCHIVE. No amendment of these Terms and Conditions shall be binding upon AN ARCHIVE unless in writing and signed by AN ARCHIVE. If any provision is held to be void or unenforceable, such provision shall be reformed only to the extent necessary to make it enforceable, and the invalidity or unenforceability of such provision shall not affect the validity or enforceability of any other provision of these Terms and Conditions.
